Well, if Sir Dave tried to throw his shield and arm up in place of the trident that would be a parry attempt. He would have to roll a natural 20 to parry it. IF he did, then he would avoid all the damage. If not, new character. AS for the alignment, most of it depends on the situation. If the guy is begging for mercy and is obviously dying Gorgath might feel compelled to offer aid. HE has already bested Dave in combat so that aspect of their interaction is now over. Of course, if he felt that Dave still presented a danger to him or others then he might finish him off. It's difficult to bef for mercy in combat. You can figure that Gorgath has anywhere from 4-6 attacks per melee at a minimum. So, he's attacking every 1 to 3 seconds. IT would be quite a feat for DAve to be struck and to get down on his knees and beg before the next blow arrives. Gorgath might kill him before realizing that he just crippled DAve.
AS for background, I think it matters quite a bit. There is no universal good or evil - we just decide which actions are good or evil for ourselves and the societal norms change from society to society. I think for ease sake Palladium has decided not to present long cultural explanations for races and cultures. That leads to the players being able to make up whatever cultural quirks they feel they need. It also allows for a megaversal system of rights and wrong, should the players want that, where most everyone beleives in the same basic principals.

In fact it is recommended as they may come back looking for revenge. What impact does the upbringing of your character have on alignment ? What is acceptable in American culture can be the reverse in another. So Gorgath may be acting honorably according to his upbringing and training, but his actions may be unacceptable to those around him and make some consider him evil.
